1. About these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and 9Aus ("9Aus", "we", "us", "our"), the operator of the website 9aus.com and any associated services (collectively, the "Service"). By creating an account or using the Service in any way, you confirm that you have read, understood and agreed to these Terms.

If you do not agree, do not use the Service.

2. Who can use the Service

• You must be at least 18 years old and able to enter into a legally binding agreement.
• You must not be located in, or a resident of, any country or region where use of the Service would violate applicable law.
• You must not be on any sanctions list maintained by the United States, the United Nations, the European Union, the United Kingdom or any other relevant authority.
• You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.

3. Your account

You agree to provide accurate, current and complete information when you register, and to keep it updated. You are responsible for safeguarding your password and any two-factor authentication (2FA) credentials, and for all activity that occurs under your account.

You must notify us immediately at support@9aus.com if you suspect any unauthorized access or security incident.

4. Identity verification (KYC/AML)

To use certain features (such as deposits, trading and withdrawals), we may require you to complete identity verification ("KYC"). You agree to provide truthful information and documents. We may refuse, suspend or close any account that we reasonably believe is associated with fraud, identity theft, money laundering, terrorism financing, sanctions evasion or any other unlawful activity.

5. Nature of the Service

The Service provides tools for viewing market data and interacting with cryptocurrency trading features. 9Aus is not a bank, is not a broker-dealer, is not a registered investment adviser, and does not custody fiat currency on your behalf as a regulated financial institution. Any digital assets shown in your account are recorded as ledger balances on the platform.

Nothing on the Service constitutes investment, financial, legal, tax or other professional advice. You make your own decisions and are solely responsible for them.

6. Risks

Cryptocurrency markets are highly volatile. You may lose some or all of the value of your assets. You acknowledge the risks set out in the Risk Disclosure, which is incorporated into these Terms by reference.

7. Fees

Trading fees, deposit fees and withdrawal fees (if any) are displayed in the Service before you confirm a transaction. We may update our fees at any time; any updates apply only to transactions made after the change.

8. Prohibited activity

You agree not to, and not to attempt to:

• Use the Service for any unlawful purpose, including fraud, money laundering, terrorism financing or sanctions evasion.
• Manipulate markets, wash-trade, spoof, layer or otherwise engage in abusive trading.
• Use bots, scrapers or automated tools without our written permission.
• Attempt to gain unauthorized access to the Service, its servers, infrastructure or other users' accounts.
• Reverse-engineer, decompile or attempt to extract source code from the Service.
• Impersonate any person, create accounts for anyone other than yourself, or sell or transfer your account.
• Upload viruses, malware or harmful code, or disrupt the Service in any way.

9. Suspension and termination

We may suspend, limit or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, violated applicable law, or created a security or compliance risk. You may close your account at any time by contacting support@9aus.com.

10. Intellectual property

All content on the Service (logos, text, graphics, software, designs) is owned by 9Aus or its licensors and is protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, lawful purposes only.

11. No warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, or freedom from errors or harmful components, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by applicable law, 9Aus, its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, trading opportunities, goodwill or other intangible losses, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for all claims arising out of or relating to the Service will not exceed the greater of (a) the total fees you paid to us in the three (3) months immediately before the event giving rise to the claim, or (b) USD 100.

13. Indemnity

You agree to defend, indemnify and hold harmless 9Aus and its affiliates from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. Material changes will be notified to you by email or via the Service. Your continued use of the Service after the changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the competent courts located in the United States, unless mandatory law in your country of residence requires otherwise.

16. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy and Risk Disclosure, are the entire agreement between you and 9Aus regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
